The appellant, Eden Butler, was employed with the respondent, Island Hotel as the Director of Pool 1 at Dolphin Cay. On the 11th of January, 2011 the Vice President of Marine Mammal Operations requested that the appellant produce a Behavior Occurrence Log which was required for a legal matter regarding a guest injury. The appellant advised that he could not find the log and was given a warning. A few days later he produced the log claiming that it had been there all the while and simply had been misplaced in another file.
