Horton, Inc.-Portland, and/or its assigns, as buyer (“Horton”), and Deschutes County, a political subdivision of the State of Oregon, as seller (“Seller”), (Horton and Seller, together, the “Parties”). The date of this Agreement above is for reference only; this Agreement shall not become effective until the Effective Date. As used throughout the Agreement, “Effective Date,” “date of this Agreement,” “mutual acceptance” and similar terms mean the later of: (a) the date of Seller’s signature on this Agreement; (b) the date of Horton’s signature on this Agreement; or (c) the date of Horton’s Corporate Approval as set forth in Section 27 below (“Corporate Approval”).
