Description: This resource is intended for use by Community Development Block Grant Disaster Recovery (CDBG-DR) grantees when a commercial lender make either a construction loan, a permanent loan, or both, and the grantee’s gap financing loan must take a subordinate lien position. This sample subordination agreement is modeled on the standard Fannie Mae subordination agreement. Although it contains the required subordination provisions, it is intended as an adaptable template for grantees to customize. If applicable state law provides for a deed of trust instead of a mortgage, conforming changes should be made to this document. The template is part of larger set of legal documents. This document is provided as a template for use by CDBG-DR grantees.
