This Further Amended Settlement Agreement (“Agreement”) is made and entered into as of this 11th day of December 2018, by and among (i) Plaintiff, as defined in Section I.BB below (“Plaintiff”), on behalf of himself and the Settlement Class, as defined in Section I.UU; and (ii) the Defendant Samsung Electronics Canada Inc. (“SECA”) to settle, fully and finally, all of the claims that have been brought in this class action lawsuit on behalf of Plaintiff and the Settlement Class against Defendant relating to certain washing machines described below. Plaintiff and Defendant are collectively referred to herein as the “Parties.”
