The seventeenth “WHEREAS” recital statement, located on page 4 of the Programmatic Agreement does not accurately describe all of the land ownership affected by the APS ancillary facilities and Transmission Lines. The original “WHEREAS” recital statement provides: “WHEREAS, the FCPP and associated APS ancillary facilities and Transmission Lines are located on Navajo Indian and Hopi Indian Reservation lands held in trust by the United States; and” is therefore changed to “WHEREAS, the FCPP and associated APS ancillary facilities and Transmission Lines are located on Navajo Indian Reservation lands held in trust by the United States and allotment(s) within the exterior boundaries of the Navajo Indian Reservation owned by individual Navajo members and Hopi Indian Reservation lands held in trust by the United States; and”.
