This End-User License Agreement (this “EULA”) is a legal agreement between you and Fullpower® Technologies, Inc. (“Fullpower”) regarding your use of certain software and services designed to work in connection with your activity and/or sleep monitoring device running MotionX firmware (the “Device”), including but not limited to: the MotionX® firmware installed on the Device (the “Firmware”), the MotionX® 365 mobile and/or web application (the “App,” and together with the Firmware, the “Software”), and the services Fullpower provides in connection with the Software (the “Services”), as each may be updated, supplemented, or replaced by Fullpower from time to time, (collectively, the “System”), as well as any data or content that is accessed or utilized by the System.
