This Agreement (“Agreement”), is executed to be effective as of (“Effective Date”), by and between BNSF RAILWAY COMPANY, a Delaware corporation ("BNSF"), and the City of Bend, OR, a municipal corporation in the State of Oregon ("Agency”).
