This Settlement Agreement (“Agreement”) is made and entered into this th day of July, 2015, among Plaintiffs Kevin Barnes, John Bettua, Alfred Blair, Martin Champion, Lauren Crane, Alan Jarashow, Lawrence L’Hommedieu, Victor Matos, and Victoria Poulsen, on behalf of themselves and the Settlement Class, as defined below, and Defendants Whirlpool Corporation and Sears, Roebuck and Co. (all parties are collectively referred to as the “Parties”), to settle, fully and finally, all of the CCU Claims, as defined below, that have been or could have been brought in three class-action lawsuits against Sears and in one putative class-action lawsuit against Whirlpool, on behalf of the Settlement Class against Defendants relating to the Washers, as defined below.
