Following the Board’s award of facilities to charter schools under Proposition 39 for the 2009-10 school year, staff was instructed to research whether it was permissible to offer multiyear facilities use agreements to charter schools on district property. The district’s Legal Services Office sent a memorandum to the Board and Superintendent on March 17, 2009, concluding that it was permissible to offer multiyear agreements to charter schools outside of the state-mandated Proposition 39 regulations. At its April 21, 2009 meeting, the Board instructed staff to proceed with developing multiyear agreements for charter schools, including criteria under which the agreements would be granted. One suggestion from the Board included a multiyear agreement coinciding in term with the school’s charter. District focus on district budget issues at the end of the 2008-09 school year precluded staff from progressing on this issue until this time.
