This First Amended Joint Exercise of Powers Agreement is executed this 10th Day of August, 2021 (“Effective Date”), amending and superseding the Joint Exercise of Powers Agreement executed on March 17, 2016, by and among the Central Water District, the City of Santa Cruz, the County of Santa Cruz, and the Soquel Creek Water District, sometimes referred to herein individually as a “Member Agency” and collectively as the “Member Agencies” for the purposes of forming the Santa Cruz Mid-County Groundwater Agency (“Agency”) and setting forth the terms pursuant to which the Agency shall operate (“Agreement”). Capitalized defined terms used herein shall have the meanings given to them in Article 1 of this Agreement.
