THIS DESIGN-BUILD AGREEMENT ("Contract" or “Agreement”) is made and entered into this ("Effective Date") by and between the CITY OF ANAHEIM, a municipal corporation ("City"), and [INSERT COMPANY NAME] ("Design-Builder") for design, procurement, site management, construction, testing, and commission of the [INSERT] (“Project”). This Agreement is effective on the Effective Date. The Effective Date of this Agreement shall be the latest date of execution hereinafter set forth opposite the names of the signators hereto. In the event Design-Builder fails to set forth a date of execution opposite the name of Design-Builder’s signator, Design-Builder hereby authorizes City, by and through its representative, to insert the date of execution by Design-Builder’s signator(s) as the date said Agreement, as executed by Design-Builder, is received by City.
