This Settlement Agreement is entered into between Plaintiffs Phillis Ideal, Jose E. and Clara E. Gomez Living Trust, and J. Fidel Candelaria, individually and on behalf of the certified Class (“Plaintiffs”) and Burlington Resources Oil & Gas Company LP, successor in interest to Burlington Resources Oil & Gas Company (“Burlington” or “Defendant”), and is subject to approval by the First Judicial District Court, County of Santa Fe, State of New Mexico (the “First Judicial District Court”). This agreement is referred to herein as the “Settlement Agreement”.
