The following Statement of Facts is incorporated by reference as part of the settlement agreement (the “Agreement”) between the United States of America, acting through the United States Attorney’s Office for the Eastern District of Washington and on behalf of the Department of Energy and the Small Business Administration (collectively the “United States”); HPM Corporation (“HPMC”); Hollie P. Mooers (“Ms. Mooers”) and Grover Cleveland Mooers (“Mr. Mooers”) (HPMC, Ms. Mooers, and Mr. Mooers collectively referred to hereinafter as “Defendants”).
