Customer agrees to purchase Hardware, Software and/or Services as specified in the relevant Netcall order form agreed by the parties (“Order Form”) and which will be subject to these terms and conditions (“Terms”). Together the Order Form and the Terms are the “Agreement”. This Agreement will only come into force when an Order Form has been issued to Customer by Netcall, Customer has returned it signed to Netcall and Netcall has returned to Customer a countersigned copy of that Order Form. No other terms will apply to the supply of any hardware, software and/or services by Netcall to Customer other than the terms expressly set out in the Agreement. For the avoidance of doubt the terms of any Customer purchase order will not be legally binding and may not act as a form of offer, counter-offer, modification, addition to and/or variation of this Agreement and/or any Order Form.
