the decommissioning of the Kickapoo River Flood Control Project and for the transfer of lands, acquired by the federal government to facilitate the creation of a reservoir, to the Ho-Chunk Nation and the State of Wisconsin [hereinafter State] on the condition that the State and the Ho- Chunk Nation [hereinafter Nation] have agreed and entered into a Memorandum of Understanding containing certain provisions required by the ACT, by October 31, 1997;
