Capitalized terms used, but not otherwise defined, in this Agreement shall have the same meaning as those terms are defined in Title 45 Code of Federal Regulations (CFR) Parts 160 and 164 (the “HIPAA Privacy Rule”). In the event of an inconsistency between the provisions of this Agreement and the mandatory provisions of the HIPAA Privacy Rule, as amended, the Privacy Rule shall control. Where provisions of this Agreement are different than those mandated in the HIPAA Privacy Rule, but are nonetheless permitted by the Privacy Rule, the provisions of this Agreement shall control. All regulatory references in this Agreement are to the HIPAA Privacy Rule unless otherwise specified.
