THIS AGREEMENT, dated this day of , 2021, is made by and between the TOWNSHIP OF RADNOR, a Home Rule municipality, with offices located at 301 Iven Avenue, Wayne, PA 19087 (hereinafter referred to as “Township”) and RADNOR TOWNSHIP SCHOOL DISTRICT, having a mailing address of 135 South Wayne Avenue, Wayne, PA 19087 (hereinafter referred to as “Developer”), owner of a certain tract of land identified as Folio No. 36-02-01233-10 (hereinafter referred to as the “Property”), and more fully described on a separate set of plans of record in the Township Office, said plans being prepared by ELA Sport Athletic Facilities Design & Consulting, consisting of fifty-two (52) sheets, dated September 18, 2020, with latest revision date of December 28, 2020, said plans being made a part hereof and incorporated herein by reference although not physically attached hereto (hereinafter referred to as the “Plan”).
