TEMPORARY ACCESS A N D U S E AGREEMENTE Agreement • January 9th, 2014 • Alabama
This TEMPORARY ACCESS AND USE AGREEMENT (the "Agreement") is executed this 13th day of January, 2014, but shall be effective as of January 13, 2014 ("Effective Date"), by and between CITY OF GULF SHORES, ALABAMA ("Licensor") and SCOTT BRIDGE COMPANY INC., a Delaware corporation ("Licensee"). Licensor owns certain properties commonly known as Little Lagoon Beach, Parking Lot, and Pass located in the City of Gulf Shores, Alabama ("Property") and Licensee seeks the right to access the Property and occupy and conduct Work (as hereinafter defined) on behalf of the Alabama Department of Transportation related to the reconstruction of the bridge and associated protective sea walls and jetties on State Highway 182 at Lagoon Pass on certain portions of the Property. In consideration of the mutual promises herein contained and other good and valuable consideration, the receipt, adequacy and sufficiency of which are hereby acknowledged, the parties hereto hereby covenant and agree as follows:
