This Settlement Agreement and Release (the “Agreement”) is entered into by and between named plaintiffs and class representatives Reneldo Rodriguez and JohnShawn Basler (“Plaintiffs” or “Named Plaintiffs”), and defendant Starwood Hotels & Resorts Worldwide, Inc. dba Westin Maui Resort & Spa (“Starwood” or “Defendant”), subject to the approval of the United States District Court for the District of Hawai‘i (the “Court”). Plaintiffs and Defendant will be referred to collectively herein as the “Parties.”
