This Agreement governs the access and use of the Software provided by Nasuni pursuant to the terms on your Order. The terms of this Agreement take precedence over any inconsistent terms in the Order. If you have entered into a separate written agreement with Nasuni regarding the use of the Software, then the terms of that agreement will prevail and will govern your use of the Software. If you have ordered the Software through a Nasuni reseller, the terms of this Agreement shall apply to the exclusion of all other varying terms and conditions other than the terms of the Order placed by the reseller for you. The Reseller is responsible for the accuracy of any such order. Resellers are not authorized to make any promises or commitments on our behalf, and we are not bound by any obligations to you other than what we specify in this Agreement. In agreeing to these terms on behalf of your employer, you are representing that you have the authority to bind that entity to the Order and this Agr
