The free use agreement, also called commodate, is an essentially gratuitous act by which an individually determined item of property, either movable or immovable, non-expendable and non-fungible is transferred by one party to another to be used for a certain period and returned in its individuality. This type of contract also acquires a personal feature, as the use of the property cannot be transferred to any other person without the prior agreement of the lender. Such a contract gives rise to obligations only on the part of the party receiving the property for free use.
