• “Extra Train” means a Train that is performed in addition to Scheduled Trains defined in the Agreement. • "Force Majeure" means circumstances, which were i) unforeseeable when entering the Agreement, (ii) which are not imputable to the party invoking Force Majeure, iii) which effects are unavoidable and (iv) which actually prevent the performance of the obligation of the Party invoking force majeure, such as (subject to the above mentioned conditions and not limited to) acts of God, natural disasters, landslides, war or threat of war, riots, hostilities, sabotage, acts or restraints of governmental authorities, shortages in energy supply, power failure, breakdown of machinery, accidents, damage to facilities, rail infrastructure problems (even when the problems can be attributed to a fault or negligence of the infrastructure manager), fire at a depot or delivery site, weather-circumstances which obstruct safely operations (fog, heavy winds, …), strikes, lock-out, and labour disputes.
