This Medfusion Merchant Agreement (the “MMA”), is a legal agreement between MEDFUSION, INC. (“Provider”, “we”, “us”, “our”) having its principal office at 5501 Dillard Drive, Cary, NC 27518, on behalf of itself and its affiliates and suppliers, and as an agent of Member Bank, and you as the merchant (“Merchant”, “you”, “your”) which applied for Services, identified in the Medfusion Pay Medical Practice Merchant Application (“Merchant Application”) as the Merchant. By applying for the Services and signing the Merchant Application, Merchant agrees to be bound by all the terms of this MMA, including any and all rules, regulations, addendums, exhibits, schedules or other agreements attached hereto or incorporated herein by reference, including, without limitation, the Merchant Application, the Glossary, the AUP, the Pricing Schedule, and the Side Letter Agreement (if any).
