This Data Processing Agreement is supplemental to the Terms and Conditions for Ontrack Services (“Terms”) and applies to (i) Kroll Ontrack, LLC having its registered office address 9023 Columbine Road, Eden Prairie, MN 55347 (“Ontrack”); and (ii) the applicable customer placing an order for data recovery services pursuant to the Terms (“Customer”). This Data Processing Agreement only applies if you, the Customer, is based in the European Union and are a Data Controller (as defined below).
