(or the applicable Sailthru Affiliate indicated in the Order Form) and the customer listed on the applicable Order Form or SOW (“Customer”). By clicking “I ACCEPT” or by entering into an Order Form or SOW that incorporates these terms and conditions (“Terms and Conditions”), you represent and warrant that you have the legal power and authority to enter into these Terms and Conditions on behalf of Customer, and that, Customer’s access and use of Sailthru’s products and service will be governed by these Terms and Conditions. If you are entering into this Agreement on behalf of a company or other entity, then “Customer” or “you” mean that entity, and you are binding that entity to this Agreement.
