(the “MLP”), THE BANK OF NOVA SCOTIA, as issuing bank (in such capacity, the “Issuing Bank”) and as administrative agent for the Lenders (as defined in the Letter of Credit Agreement (as defined below)) (in such capacity, the “Administrative Agent”), and each of the Lenders signatory hereto.
