This trademark license agreement (“Agreement”) accompanies a shipment of live plants (“Shipment”) of the ‘Meibenbino’ rose variety (“Petite Variety”), and/or one or more varieties of roses within the Drift® and/or Knock-Out® families of roses, including the ‘Radyod’, ‘Radrak’, ‘Radtko’, ‘Radgor’, ‘Radcon’, ‘Radtkopink’, ‘Radcor’, ‘Radsunny’, ‘Radwhite’, ‘Meimirrote’, ‘Meipicdevoj’, ‘Meigalpio’, ‘Meidrifora’, ‘Meisentmil’, ‘Meiswetdom’, ‘Meijocos’, ‘Meiggili’, ‘Novarospop’, and ‘Meizorland’ rose varieties (“Patented Drift/Knock- Out Varieties”) (collectively the “Licensed Varieties”), which have been delivered to the Receiving Party by or on behalf of The Conard- Pyle Company (“CP”) of 8 Federal Road, Suite 6, West Grove, Pennsylvania 19390, and/or its Star Roses & Plants (“SRP”) business.
