This Data Protection Agreement and its annexes (“DPA”) establishes minimum data protection and cyber- security standards and related requirements and forms part of the contract, including a commercial agree- ment, a service agreement or an order (the “Agreement”) (except Cepheid C360 User Agreement). This DPA is entered into by and between the Customer (as defined in the Agreement) and Cepheid (as defined in the Agreement) and shall continue in full force and effect for the duration of the Agreement. Cepheid and Cus- tomer are hereinafter individually referred to as a “Party” or collectively as the “Parties”.
