New positions created during the term of the Collective Agreement not referenced in Article 2.01 - Recognition above and which in the opinion of the Gallery are excluded from the bargaining unit as a result of S. 1 /(3) (b) of the Labour Relations Act may be the subject of an application to the OLRB pursuant to S. 1 06(2) of the Labour Relations Act in the event the Union disputes such exclusion. If the Board determines the person performing the job duties and responsibilities is an employee within the meaning of the Act, such position shall be included in the bargaining unit. The inclusion of any person in the bargaining unit shall be effective as of the date of the decision of the OLRB and such decision shall not, in any event, have retroactive effect prior to the date of application by the Union to the OLRB. It is agreed by both parties that the Board's decision will be final and binding.
