This Data Processing Agreement (“DPA”) reflects the agreements reached between AllCloud BSD Ltd. (“Company”) and you, the customer (“Customer”) with respect to the Processing of Personal Data (as such terms shall be defined below) under the agreement executed between the Company and the Customer governing the Customer's use of the Company's services ("Agreement" and "Services", respectively). This DPA forms an integral part of the Agreement. This DPA shall only apply to the extent that The EU Data Protection Law (as defined below) applies to the Processing (as such term shall be defined below) of Personal Data (as such term shall be defined below) under the Agreement including in the event that: (a) the Processing is in the context of the activities of an establishment of either party in the European Economic Area (“EEA”); or (b) the Personal Data relates to Data Subjects who are in the EEA and the Processing relates to the offering to them of goods or services or the monitoring of the
