This agreement (“Agreement”) is a binding agreement between Maxeler Technologies, Inc. (“Maxeler”) and you and, if applicable, the company or legal entity that you represent (collectively “You”) for the use of the Services (defined below) provided by Maxeler under a purchase order agreed to by you and Maxeler (the “Ordering Document”), including any such Ordering Document set forth on the applicable click-through Internet form provided by Amazon Web Services (“AWS”). This Agreement incorporates by reference the Privacy Policy posted at www.maxeler.com/docs/privacy.pdf (“Privacy Policy”), the Terms of Use posted on www.maxeler.com/docs/terms.pdf (“Terms Of Use”), and the Ordering Document, as these policies and terms may be modified by Maxeler or its affiliates from time to time. Please read this Agreement carefully. Your use of the Services is conditioned upon your acceptance of this Agreement.
