Common use of Zoning Clause in Contracts

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (ii) a zoning report, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual the Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) an ALTA 3.1 zoning endorsement for to the applicable Title Insurance Policy Policy, if available or (iiiii) a other evidence of zoning reportcompliance, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual the Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) an ALTA 3.1 zoning endorsement for to the applicable Title Insurance Policy or (iiiii) a other evidence of zoning reportcompliance, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, in respect of each Property, either (i) (A) letters or other evidence with respect to each Individual such Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building lawslaws or a zoning report from a reputable firm, in form and substance satisfactory to Lender, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, to the extent available in the State in which the applicable Property is located or (ii) a zoning reportopinion letter with respect to such Property, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) either (A) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (iiB) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and or (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, or (ii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s 's option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy title insurance policy, or (iiiii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual the Property, Lender shall have received, at Lender’s 's option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, or (iiiii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (ii) a zoning report, in each case in form and substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, in respect of the Property, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building lawslaws or a zoning report from a reputable firm, in form and substance satisfactory to Lender, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, to the extent available in the State in which the Property is located or (ii) a zoning reportopinion letter with respect to the Property, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other PersonsPersons such as Urban Concepts or PZR) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (iiC) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) received (A) letters or other evidence with respect to each Individual Property the Properties from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (ii) a zoning reportPolicy, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s 's option, either (i) (A) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, or (ii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (ii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) either (Ax) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building lawslaws or (y) a report of Urban Concepts, and (Bii) if available in the applicable State, an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or (ii) a zoning report, in each case in substance reasonably satisfactory to LenderPolicy.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s Borrower's option, either (i) (A) letters or other evidence with respect to each Individual such Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and or (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy Policy, or (iiC) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender.

Zoning. With respect to each Individual Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (B) an ALTA 3.1 zoning endorsement for the applicable Title Insurance Policy or Policy, (ii) a zoning reportopinion letter, in each case in substance reasonably satisfactory to Lender, (iii) or a report of the Planning and Zoning Resources Company.

With respect to each Individual the Property, Lender shall have received, at Lender’s option, either (i) (A) letters or other evidence with respect to each Individual the Property from the appropriate municipal authorities (or other Persons) concerning applicable zoning and building laws, and (Bii) an ALTA 3.1 zoning endorsement for to the applicable Title Insurance Policy Policy, or (iiiii) a other evidence of zoning reportcompliance, in each case in substance reasonably satisfactory to Lender.
