Common use of Written Confirmation of Exercise Clause in Contracts

Written Confirmation of Exercise. Applicable. Buyer shall give exercise notice which may be given orally (including by telephone) during the Exercise Period but no later than the Notification Date. Buyer will execute and deliver a written exercise notice confirming the substance of such oral notice, however, failure to provide such written notice will not affect the validity of the oral notice.
