Workers’ Right to Know. The Contractor shall comply with RCW 49.70 and WAC ▇▇▇-▇▇-▇▇▇ regarding workplace surveys and material safety data sheets for “hazardous” chemicals at the Site.
Workers’ Right to Know. The Washington State Department of Labor and Industries requires employers and employees to be aware of the hazardous substances in their work environment. Washington Administrative Code (WAC) ▇▇▇-▇▇-▇▇▇ requires, among other things, that all manufacturers and/or distributors of hazardous substances must include completed Material Safety Data Sheets (MSDS) for each hazardous material. Additionally, each container of hazardous material must be appropriately labeled with (1) the identity of the hazardous material, (2) appropriate hazardous warnings, and (3) the name and address of the chemical manufacturer, importer, or other responsible party. The effect of this regulation on this Agreement is that Chartwells is required to keep a file, at the job site, readily available to its employees, of MSDS reports for all hazardous wastes used in Chartwells’ operations. The Department of Labor and Industries may levy appropriate fines against employers for noncompliance, and agencies may withhold payment pending receipt of a legible copy of the MSDS. It should be noted that Occupational Safety and Health Administration (OSHA) Form 20 is not acceptable in lieu of this requirement unless it is modified to include appropriate information regarding “carcinogenic ingredients” and “routes of entry” of the product(s) in question.
