The WORK SCHEDULES - PREMIUM PAY clause defines the conditions under which employees are entitled to receive additional compensation for working outside of standard hours. WORK SCHEDULES - PREMIUM PAY. Section 1. This Article is intended only to define the normal hours of work and to provide the basis for the calculation of premium pay, if any. Nothing shall be construed as a guarantee of hours of work per day or per week.
Section 2. A payroll period is eighty (80) hours of work within a fourteen (14) calendar day period.
Section 3. Work shifts, work breaks, staffing schedules, and the assignment of employees, shall be established by the EMPLOYER.
A. Where staffing schedules are routinely subject to change, a staffing schedule showing the regular workdays and work hours of all employees shall normally be prepared and posted at least fourteen (14) calendar days in advance of their effective date. Such staffing schedules, once posted, will only be modified when necessitated by unscheduled employee absences and unscheduled changes in workload. A temporary change in the staffing schedule of a PART-TIME or LIMITED DURATION EMPLOYEE is not a staffing schedule change for purposes of this Article. Employees may mutually agree to exchange days, shifts or hours of work with the approval of their supervisor provided such change does not result in the payment of overtime or accrual of compensatory time. Hours worked as part of a shift exchange shall be excluded in the calculation of hours for which the employee would otherwise be entitled to overtime compensation, and that each employee will be credited as if they had worked their normal schedule for that shift.
B. If changes concerning length and/or start and end of shifts for a work unit are to be made in existing full- time shifts, the EMPLOYER shall notify the UNION in advance of implementing the proposed changes and will provide the UNION the opportunity to meet and confer with respect to the proposed changes and their effect on employees. Such meet and confer sessions shall be conducted prior to the implementation of the change, except where an EMERGENCY or other unpredictable condition makes this impractical.
C. Employees shall normally be granted two (2) paid fifteen (15) minute relief periods during each full work shift of eight hours or more at times designated by the EMPLOYER.

Worked hours (including approved paid vacation/PTO) in excess of the designated work shift (8 hours or more, e.g., such as 10 or 12-hour shifts) or an average eighty (80) hours per payroll period shall be overtime and compensated at one and one-half (1 1/2) times the employee's REGULAR RATE OF PAY or one and one-half (1 ½...

15.2 Work shifts, staffing schedules and the assignment of employees thereto shall be established by the department head.
15.3 The normal work schedule shall be four (4) eight (8) hour days on duty followed by two (2) days off duty. Other work schedules may be authorized to accommodate the services performed by the department.
15.4 Effective January 1, 2021, all full-time employees or part-time employees receiving pro rata benefits, required to work on Saturday or Sunday as part of their regular schedule shall be compensated at the rate of eighty-five ($.85) cents per hour for each hour worked. Compensation under this section will be earned for the entire period worked, provided at least five (5) hours of the period worked fall on the day for which the additional compensation is being paid. These differentials will not be paid where such work constitutes overtime under the provisions of the Agreement.
15.5 Any full-time employee who works on a shift beginning earlier than 6 a.m., or ending later than 6 p.m., shall be entitled to receive a night differential for the entire shift, provided at least four (4) hours of the shift were worked between the hours of 6 p.m. and 6 a.m. The night differential shall be adjusted each time the night differential is adjusted for the Deputy Sheriff classification. It shall be adjusted by the same percentage as the increase in differential to the Deputy Sheriff classification. Employees working on a continual night shift arrangement shall be paid this differential during all paid leaves.
15.6 Compensation shall not be paid more than once for the same hours worked under any provisions of this Agreement, nor shall there be any pyramiding of premium compensation.

Section 6. When the EMPLOYER determines changes in work schedules are necessary, notice shall be given to employees in advance whenever practicable.
Section 7. Consistent with the HR Rules, when an employee is expressly assigned to perform the duties of a position allocated to a different classification that is temporarily unoccupied, and such assignment is for forty (40) or more continuous REGULAR HOURS, the employee shall be paid for all such hours at the employee's current salary rate when assigned to work in a lower or equal class, or at a rate within a higher range which is equal to the minimum rate for the higher class or a minimum of three (3) percent higher than the employee's current salary, whichever is greater. See H.

15.4 All permanent full-time employees shall serve a one (1) year probationary period.
15.5 Effective the first full pay period following January 1, 2022, all full-time employees or part-time employees receiving pro-rata benefits, required to work as part of their regular schedule, between the hours of Friday 0630 (6:30am) to Monday 0630 (6:30am) shall be compensated a differential at the rate of eighty-five cents ($0.85) for each hour worked between the above- identified hours.
15.6 Any full-time employee who works on a shift beginning earlier than 6 a.m. or ending later than 6
15.7 will apply beginning January 1, 1989 and continue for 1990.
15.7 Compensation shall not be paid more than once for the same hours worked under any provision of this Agreement.
15.8 Employees who have not completed their probationary period may be prohibited from bidding shifts.

Employees assigned to the Court House will work the hours established for all County Court House employees.
6.4 All full-time employees required to work on a Saturday or Sunday as part of a regular schedule shall be compensated at the rate of seventy-five cents ($.75) per hour for each hour worked effective 1/1/22. Compensation under this Section will be in addition to the employee's regular salary and will be earned for the entire period worked, provided at least five (5) hours of the period worked fall on the day for which the additional compensation is being paid.
6.5 Any full-time employee as part of a regular schedule who works on a shift beginning earlier than 6 a.m. or ending later than 6 p.m. shall be entitled to receive a night differential for the entire shift, provided at least four (4) hours of the shift are worked between the hours of 6 p.m. and 6
a. m. The night differential shall be paid as additional compensation equivalent to six and one-half percent (6-1/2%) of Step A in the salary range established for the employee's classification in the bargaining unit. Effective April 1, 1997, employees working on a continual night shift arrangement shall be paid this differential during all paid leaves.
6.6 Compensation shall not be paid more than once for the same hours worked under any provisions of this Agreement, nor shall there be any pyramiding of premium compensation. Effective the first full pay period following January 1, 2025, Probation Officers regularly assigned to the Juvenile Detention Center, may be eligible to receive both night and weekend differential when the hours worked are determined to be eligible under Article 6.4 and 6.5.

Section 4. Worked hours in excess of an averaged forty (40) hours per week shall be overtime and compensated at one and one-half (1-1/2) times the employee’s base pay rate, or one and one-half (1-1/2) hours compensatory time for each hour subject to the provision that eligibility for overtime premium requires prior approval of the overtime work by the employee’s immediate supervisor or his/her designee. Overtime premium shall be provided in the form of either cash payment or compensatory time as determined by the EMPLOYER. Compensated vacation, holidays and compensatory time shall be considered time worked for purposes of this Article except when they are used in lieu of sick leave.
Section 5. Where unassigned work needs exist in the juvenile correctional institutions in addition to regular assigned hours, subject to program requirements, employees shall be assigned work hours in the following manner:
A. First to regular part-time staff who have not been assigned work beyond 40 hours in a given work week.
B. To the extent that staffing requirements are not met by assignments to regular part-time staff, on-call staff will be assigned work hours consistent with the assignment limits for their appointments.
C. To the extent that work needs cannot be met through the above assignments, full-time staff assigned to the work location affected will be offered additional hours in accordance with their seniority beginning with the most senior.
1. When overtime is offered to full-time staff under sub-section C (above), overtime will be limited to no more than 16 consecutive hours of work in any 24 hour period, except in stated emergencies.
D. When the overtime to be worked totals 2 hours or less, overtime will be offered, by seniority, to staff already on the premises.
