Common use of Withholding for unpaid wages and liquidated damages Clause in Contracts

Withholding for unpaid wages and liquidated damages. The Federal Aviation Administration or the Sponsor shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor or subcontractor under any such contract or any other Federal contract with the same prime contractor, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractor, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 above.

The Federal Aviation Administration FAA, MoDOT or the Sponsor shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, withheld from any monies payable on account of work performed by the contractor or subcontractor under any such contract or any other Federal contract with the same prime contractor, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractor, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 Subsection (20)(K)2. above.

The Federal Aviation Administration or the Sponsor RIAC shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor or subcontractor under any such contract or any other Federal contract with the same prime contractor, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractor, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 above.

The Federal Aviation Administration (FAA) or the Sponsor Owner shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies moneys payable on account of work performed by the contractor consultant or subcontractor subconsultant under any such contract or any other Federal contract with the same prime contractorconsultant, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractorconsultant, such sums as may be determined to be necessary to satisfy any liabilities of such contractor consultant or subcontractor subconsultant for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 aboveof this clause.

The Federal Aviation Administration or the Sponsor Owner shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor Design Professional or subcontractor subconsultant under any such contract or any other Federal contract with the same prime contractorDesign Professional, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractorDesign Professional, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor subconsultant for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 B. above.

The Federal Aviation Administration or the Sponsor OWNER shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor ENGINEER or subcontractor under any such contract or any other Federal contract with the same prime contractorENGINEER, or any other Federally-Federally- assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractorENGINEER, such sums as may be determined to be necessary to satisfy any liabilities of such contractor ENGINEER or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 above.

The Federal Aviation Administration or the Sponsor Authority shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor Contractor or subcontractor under any such contract or any other Federal contract with the same prime contractorContractor, or any other Federal contract with the same prime contractor , or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractorContractor, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 (2)) above.

The Federal Aviation Administration or the Sponsor Airport Authority shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any monies payable on account of work performed by the contractor CMR or subcontractor under any such contract or any other Federal contract with the same prime contractor, or any other Federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractor, such sums as may be determined to be necessary to satisfy any liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph 2 B above.
