The Wireless Service Availability clause defines the extent to which wireless services will be provided and accessible under the agreement. It typically outlines the geographic areas covered, any limitations due to network capacity or technical constraints, and may specify that service is not guaranteed in all locations or at all times. This clause ensures that both parties have a clear understanding of the expected service coverage and helps manage expectations regarding potential service interruptions or limitations.
Wireless Service Availability. Wireless Service uses radio technologies and is subject to transmission and service area limitations, interruptions, and dropped calls caused by atmospheric, topographical or environmental conditions, cell site availability, the router or its installation, governmental regulations, system limitations, maintenance or other conditions or activities affecting operation. Wireless Service is only available within each applicable plan coverage area, within the operating range of the wireless systems, and routers that are approved to operate on our network. In some areas, Wireless Service may be provided by a third-party roaming carrier and subject to agreements with such carriers. Data service on such other networks may be limited or slowed. You must activate CPE within the areas served by our owned and operated network. Verizon Wireless reserves the right to terminate any Wireless Service that roam permanently on a third-party carrier's network. Your lines that are in a fixed location must always be within the areas served by our owned and operated network.

Your Company acknowledges that in some areas, Wireless Service may be provided by a third-party roaming carrier, subject to our agreements with such carriers. Data service on these roaming carriers’ networks may be limited or slowed. Third-party roaming carriers are not our affiliates or subcontractors, and we bear no liability for their network performance or their actions or omissions. You must activate your Devices within the areas served by our owned and operated network in the United States and must deploy your fixed-location Devices within these areas. Your mobile Devices may be used to roam on the networks of our roaming partners in the United States and, if permitted by your plan, other countries, but must be primarily used on our owned and operated networks in the United States. We reserve the right to terminate any Corporate Subscriber lines and M2M Lines that are not primarily used on our owned and operated network.
Wireless Service Availability. For the Wireless Service Availability Service Level, Availability will be measured for the wireless environment and shall mean the period when the wireless environment is fully functional (allowing for workarounds within the system that are acceptable to Company) and providing Services to the entire population of Authorized Users.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.
