Whereas Clause. Effective February 1, 2007, the first “Whereas” clause of the Contract shall be deleted and replaced in its entirety by the following provision:
Whereas Clause. 1. If one of the sponsors is a non-profit entity, the Whereas clause following the reference to this note should be included in your agreement. If the Whereas clause is included in the agreement, fill in the date of the letter and the name of the affected local government that has consented to the non-profit entity serving as one of the sponsors. The civilian format for any dates included in the agreement should be used. (Example: January 22, 2014)
Whereas Clause. (A) and Section 2.01 of the Credit Agreement are hereby amended by changing the Credit Facility Amount from $138,478,000 to $160,182,000.

Whereas Clause. In the third whereas clause, the following words -------------------- shall be inserted between "Xxxxxx Xxxxxxx Capital International," and "and MSCI":
Whereas Clause. 1. Party A is a telecom operation corporation approved by competent authorities of Ministry of Information Industry of the State Council. It provides basic telecom services and value-added telecom services to the publics nationwide, has its own telecom base network, data service platform, service marketing system and a large number of customers. Hence, Party A is fully qualified for signing and performing this agreement.
Whereas Clause. The seventh WHEREAS clause of the Purchase Agreement is amended and restated in its entirety and an additional WHEREAS clause is added immediately thereafter as follows:

The civilian format for any dates included in the agreement should be used. (Example: January 22, 2004) B. Article XIII.D. – Include optional Article XIII.D. in the agreement only if Option (1) described in paragraph A. of this note is selected elsewhere in the agreement (agreement addresses performance of both design and construction of the project in accordance with project implementation procedures outlined in Appendix F, ER 1105-2-100). If optional Article XIII.D. is not included (because the agreement addresses construction only), reletter the remaining paragraphs in Article XIII. Relettering the remaining paragraphs in Article XIII is not considered a deviation from the model.
Whereas Clause. The Whereas Clauses herein are a part of this Agreement and are incorporated herein by reference.
Whereas Clause.
