Where the Sub. Contract Works have reached practical completion the retention which the Contractor may deduct and retain shall be 2.5% of the Sub-Contract Price.
Where the Sub. Committee of the JJEC determines that the job is already paid in accordance with the Plan and therefore should not be referred to the JJEC for reevaluation, the employee shall have a right of appeal to the JJEC. The JJEC will only grant an appeal if the there is a unanimous decision by the members of the committee to do so. If an appeal is granted the job shall be rated in accordance with the Plan.
Where the Sub. Contractor considers a direction given by Total to constitute a Variation in accordance with subclause 11.1(a), if it wishes to make a claim against Total, the Sub-Contractor must notify Total within five (5) Business Days of receiving that direction.
Where the Sub. Contract Works include any element of design by the Sub-Contractor such design shall be carried out exercising all the reasonable skill, care and diligence to be expected of a competent designer who is experienced in preparing design work of a similar scope, nature and complexity, and in any event shall be fit for its intended purpose.
