Common use of Whenever Applicable Clause in Contracts

Whenever Applicable. Legislation requires that evidence referred to in subsection 9.3(1) be in the form of a statutory declaration, the Warrant Agent may accept such statutory declaration in lieu of a certificate of the Corporation required by any provision hereof. Any such statutory declaration may be made by any one or more duly authorized representative of the Corporation.

Legislation requires that evidence referred to in subsection 9.3(1Subsection 10.03(3) be in the form of a statutory declaration, the Warrant Agent may accept such statutory declaration in lieu of a certificate of the Corporation Company required by any provision provisions hereof. Any such statutory declaration may be made by any one or more duly authorized representative of the CorporationPresident, the Vice-President, the Secretary, the Treasurer, any Assistant Secretary or any Assistant Treasurer of the Company.
