Common use of WHEN AND HOW EFFECTED Clause in Contracts

WHEN AND HOW EFFECTED. Provided that the BUYER shall concurrently with delivery of the VESSEL release to the BUILDER the fifth instalment as set forth in Article X.2. hereof and shall have fulfilled all of its obligations provided for in this CONTRACT, delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties hereto.

WHEN AND HOW EFFECTED. Provided that the BUYER shall concurrently with delivery of the VESSEL release to the BUILDER the fifth instalment as set forth in Article X.2. hereof and X.2.hereofand shall have fulfilled all of its obligations provided for in this CONTRACTCONTRACT (as it may have been amended from time to time) prior to the delivery of the VESSEL, delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate induplicate and signed by each of the parties hereto.

WHEN AND HOW EFFECTED. Provided that the BUYER shall concurrently with delivery of the VESSEL release to the BUILDER the fifth sixth instalment as set forth in Article X.2. hereof and the BUYER and the BUILDER shall have fulfilled all of its their obligations provided for in this CONTRACT, delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties hereto.

Provided that the BUYER shall concurrently with delivery of the VESSEL release to the BUILDER the fifth sixth instalment as El s set forth in Article X.2. hereof and shall have fulfilled all of its obligations provided for in this CONTRACT, delivery of the VESSEL shall be forthwith effected upon acceptance thereof there() by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto ;lereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties hereto.

WHEN AND HOW EFFECTED. Provided that the BUYER shall concurrently with the delivery of the VESSEL release to the BUILDER the fifth fourth instalment as set forth in Article X.2. X.2 hereof and that the parties hereto shall have fulfilled all of its their respective obligations provided for in this CONTRACTCONTRACT (including delivery to the BUYER of the documents specified in Paragraph 3 of this Article), delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties hereto.

WHEN AND HOW EFFECTED. Provided that the BUYER shall concurrently with delivery of the VESSEL pay or release to the BUILDER the fifth instalment Fifth Instalment as set forth in Article X.2XI.2. hereof and shall have fulfilled all of its obligations provided for in this CONTRACT, delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE Protocol of Delivery and Acceptance acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties hereto.

WHEN AND HOW EFFECTED. Provided that the BUYER shall shall, concurrently with delivery of the VESSEL VESSEL, release to the BUILDER the fifth instalment installment as set forth in Article X.2. X.2 hereof and shall have fulfilled all of its obligations provided for in this CONTRACT, delivery of the VESSEL shall be forthwith effected upon acceptance thereof by the BUYER, as hereinabove provided, by the concurrent delivery by each of the parties hereto to the other of a PROTOCOL OF DELIVERY AND ACCEPTANCE ACCEPTANCE, acknowledging delivery of the VESSEL by the BUILDER and acceptance thereof by the BUYER, which PROTOCOL shall be prepared in duplicate and signed by each of the parties patties hereto.
