Weather Contingency Clause Samples
Weather Contingency. If the Producer postpones a recording day because of weather, the Performer shall be paid:
a) In the case of a first (1st) postponement:
i. If the Producer postpones a recording day and provides the Performer with more than eighteen (18) hours’ notice before the call for that day, no amount is due to the Performer.
ii. If the Producer postpones a recording day and provides the Performer with less than eighteen (18) hours’ notice before the call for that day, the Performer shall be paid fifty percent (50%) of the contracted fee for that day.
b) In the case a recording day is postponed for a second (2nd) time or more:
i. If the Producer postpones a recording day for the second time or more, the Performer shall be paid fifty percent (50%) of the contracted fee for that day regardless of the notice provided.
c) If a recording day is cancelled, the Performer shall be paid one hundred percent (100%) of the contracted fee.
