WCMRC Fees Clause Samples
The WCMRC Fees clause establishes the obligation for a party to pay fees associated with services provided by the Western Canada Marine Response Corporation (WCMRC). Typically, this clause outlines the types of fees that may be charged, such as annual membership fees or charges for specific spill response services, and may specify the timing and method of payment. Its core practical function is to ensure that the costs of marine spill response preparedness and services are clearly allocated and understood, thereby supporting compliance with regulatory requirements and facilitating prompt payment for essential environmental protection services.
WCMRC Fees. (a) WCMRC Fees means all fees charged by WCMRC for providing Marine Spill Response Services including, but not limited to, equipment charges (for owned, non-owned or leased equipment including for repair and replacement of equipment), overhead costs, salaries, wages and benefits paid to personnel, food, lodging and travel costs for personnel, fees paid to contractors or subcontractors, fees paid to mutual aid partners or any other parties, and the costs of Demobilization.
(b) Without limiting the foregoing, where WCMRC has published a schedule of fees, the costs associated with those items will be in accordance with the most currently published schedule.
(c) Schedules of WCMRC Fees are subject to change from time to time and the current fee schedules are available upon request and posted on WCMRC’s website. Owner acknowledges and agrees that it has had the opportunity to request and review the current fee schedules and agrees that same are fair and reasonable.
