Common use of Warranty of Fitness to Practice Law Clause in Contracts

Warranty of Fitness to Practice Law. Attorney warrants that he/she is duly licensed to practice law in the State courts of the State of Idaho and is a member in good standing of the Idaho State Bar and that Attorney will immediately notify the Board in writing if a change in that status occurs during the term of this Agreement. Attorney also warrants that he/she is competent and qualified to represent criminal defendants at all levels of proceedings called for in this Agreement. If at any time during the term of this Agreement, Attorney is unable to practice law within the State courts of the State of Idaho, whether on a permanent, temporary or suspended basis, the Board, in its sole and absolute discretion, may terminate this Agreement and have no additional obligations hereunder. The County reserves the right to terminate this contract with Attorney if either the Magistrate Court or the District Court advises the County that Attorney is providing inadequate representation under the contract.
