Common use of WAR EXCLUSION Clause in Contracts

WAR EXCLUSION. No liability shall attach hereto in respect of any Ultimate Net Loss which is occasioned by war, invasion, hostilities, acts of foreign enemies, civil war, rebellion, insurrection, military or usurped power, or martial law or confiscation by order of any government or public authority. Nevertheless, this Article shall not be construed to apply to Ultimate Net Loss occasioned by riots, strikes, civil commotion, vandalism, malicious damage, including acts committed by agents of any government, party or faction engaged in war, hostilities or other warlike operation, provided such agents are acting secretly and not in connection with any operations of military or naval armed forces.
