Common use of Waiver of Breach or Default Clause in Contracts

Waiver of Breach or Default. The waiver by a Party of any breach of or default under any of the provisions of this Agreement or the failure of a Party to enforce any of the provisions of this Agreement or to exercise any right hereunder shall not constitute or be construed as a waiver of any other breach or default or as a waiver of any such rights or provisions hereunder.

Waiver of Breach or Default. The waiver No waiver, or alleged waiver, by a Party either party of any breach of or default under of any provision of the provisions of this Agreement or the failure of a Party shall be deemed to enforce any of the provisions of this Agreement or to exercise any right hereunder shall not constitute or be construed as a waiver of any other subsequent breach or default or as a waiver default. Nor shall the existence of any such rights claim or provisions hereundercause of action by either party against the other, whether predicated on the Agreement or otherwise, constitute a defense to either party’s enforcement of any of the provision(s) herein.
