Common use of WAIVER NOT A LIMITATION TO ENFORCE Clause in Contracts

WAIVER NOT A LIMITATION TO ENFORCE. 24.2 The Vendor/Developer may, at its sole option and discretion, without prejudice to its rights as stated in this Agreement wave the breach by the Allottee in not making payments as per the payment plan [Annexure C] including waving the payment of interest for delayed payment. It is made clear and so agreed by the Allottee that exercise of discretion by the Vendor/Developer in the case of one allottee shall not be construed to be a precedent and /or binding on the Vendor/Developer to exercise such discretion in the case of other allottees.

It is made clear and so agreed by the Allottee Allottee(s) that exercise of discretion by the Owner/Vendor/Developer Promoter in the case of one allottee Allottee(s) shall not be construed to be a precedent and /or and/or binding on the VendorOwner/Developer Vendor/ Promoter to exercise such discretion in the case of other allotteesAllottee(s).

It is made clear and so agreed by the Allottee that exercise of discretion by the Vendor/Developer Owner/ Vendor in the case of one allottee shall not be construed to be a precedent and /or binding on the Vendor/Developer Owner/ Vendor to exercise such discretion in the case of other allottees.

It is made clear and so agreed by the Allottee that exercise of discretion by the Vendor/Developer Promoter in the case of one allottee Allottee shall not be construed to be a precedent and /or binding on the Vendor/Developer Promoter to exercise such discretion in the case of other allotteesAllottees.

It is made clear and so agreed by the Allottee / Purchaser that exercise of discretion by the Vendor/Developer Promoter in the case of one allottee Allottee / Purchaser shall not be construed to be a precedent and /or binding on the Vendor/Developer Promoter to exercise such discretion in the case of other allotteesAllottees / Purchasers .
