VOID MORTGAGES Clause Samples
The "Void Mortgages" clause establishes that certain mortgages or security interests are considered legally invalid or unenforceable under specified circumstances. Typically, this clause applies when a mortgage is granted in violation of statutory requirements, such as lacking proper registration, being made without necessary authority, or contravening public policy. Its core practical function is to protect parties and the integrity of the property system by ensuring that only properly executed and lawful mortgages are recognized, thereby preventing fraudulent or unauthorized encumbrances on property.
