Common use of Visits to Site Clause in Contracts

Visits to Site. The architect/engineer shall make sufficient visits to the site for the exclusive purpose of observing the progress of the work in order to evaluate, in general, whether the contractor (s) are achieving the applicable performance parameters as generally embodied in the project’s design and communicated via the drawings and specifications. The architect/engineer shall not be responsible either directly or indirectly for the initiation, formulation, supervision or overseeing of construction means, methods, techniques, sequences or procedures, or safety precautions, practices, procedures or program employed in connection therewith. These matters shall be within the exclusive discretion, control, and responsibility of the contractor (s). Architect/engineer shall not in any way be responsible for the failure of contractor (s) to perform the construction work in accordance with the drawings and specifications. The architect/engineer shall keep the County informed (i.e. written reports of the progress and quality of work) and guard the County against defects and deficiencies in the work performed by contractor (s).
