Violent Act Sample Clauses
Violent Act. A violent act is defined as an intentional use of physical force that results in physical injury.
11.3.1 METRO/▇▇▇▇▇▇ agrees to reimburse or replace to its AFSCME members the following items to the extent where such items were lost as a result of a violent act against the AFSCME member while he/she was on duty. It is also understood that it shall be the duty and responsibility of the AFSCME member to use caution and diligence in the protection of his/her and Metro/LACMTA property.
11.3.2 Replace and/or repair broken prescription glasses based on the member’s vision plan, repair or replace uniform/civilian clothes damaged or taken from the AFSCME member during the course of a violent act.
11.3.3 Replace or reimburse the AFSCME member not to exceed one hundred fifty ($150) dollars as the value of a standard watch as required by Metro/LACMTA.
11.3.4 Reimburse up to ten ($10) dollars of personal funds or miscellaneous items carried by the AFSCME member, provided the AFSCME member had this amount or miscellaneous items in his/her possession at the time of the violent act.
11.3.5 An incident involving a violent act must be reported immediately.
11.3.6 It is further agreed that if the AFSCME member is physically injured as a result of a violent act by another person, such injury resulting in loss of time shall be paid 100% for the first seven (7) calendar days of disability.
11.3.7 In the event an AFSCME member loses time due to a stolen or broken standard watch or prescription glasses, he/she will be compensated for the remainder of their shift. BEHAVIOR CORRECTION AND DISCIPLINE
12.1 APPLICATION This Article applies to all AFSCME represented employees who have completed their initial probationary period. Please refer to the flowchart in Appendix B. Both AFSCME and the LACMTA are committed to a spirit of cooperation and to resolving problems as quickly as possible. Informal discussions and Interest Based Problem Solving (IBPS) meetings, tools, and techniques are encouraged. Training in Investigative Procedures and Interest Based Problem Solving (IBPS) tools and techniques will be scheduled for Division Managers and AFSCME Officers and Stewards within 120 calendar days of final approval and ratification of agreement.

Violent Act. A physical act or attempted act done with malice and intent to cause injury or death to person or persons. This excludes acts committed, threatened or attempted by the “company”, or any of the “company’s” partners, directors, officers or trustees.
